The Rutland Dundee Fire Protection District is seeking a court order to end its contract with the West Dundee Fire Protection District, which currently provides fire and ambulance services to around 30 homes. The district claims that Rutland residents are unfairly subsidizing these services, as they pay three times more than their counterparts in West Dundee.
The original agreement, signed in November 2004, set an annual cost of $7,500 for the services. However, Rutland officials argue that the deal was last modified by board members who are no longer in office, making it invalid under current leadership. They also claim that the agreement violates the Property Tax Limitation Act, as Rutland is taxing residents at the maximum allowed rate, while West Dundee residents pay significantly less.
Tom Gilbert, attorney for the West Dundee Fire Protection District, said the contract should still be honored, as it was legally binding and has been adjusted for inflation over the years, now totaling approximately $12,000 annually. “It’s the deal they made,†he stated, emphasizing that the district plans to stick to the original terms.
The lawsuit, filed in Kane County, highlights that all previous fire trustees who approved the contract have since left the board, leaving the current administration without legal obligation to uphold the agreement. If the court rules in favor of Rutland, the West Dundee district may need to seek alternative service providers or renegotiate with Rutland at a higher cost.
Historically, the West Dundee Fire Protection District had contracted with the village of West Dundee for fire services in the early 2000s, but the arrangement ended when the village requested a rate increase. This led to the 2004 agreement with Rutland. Both parties are set to appear in court on August 13 to resolve the dispute.
